Consumer Health Data Privacy

Sageware Solutions Inc. (“we,” “our,” “us”) is committed to protecting the privacy and security of your health-related data. This Consumer Health Data Privacy Policy outlines how we collect, use, and safeguard your health data when you use the Busolv app (“the App”). By using the App, you agree to the practices described in this policy. If you do not agree with this policy, you should not use the App.

1. What is Health Data?

Health data includes any information that relates to your physical health, nutrition, fitness, or well-being that is collected through the App, such as data you provide regarding your health goals, dietary habits, weight, height, and food consumption.

2. What Health Data We Collect

We collect the following health-related data in order to provide personalized nutrition and fitness insights:

2.1. Dietary and Food Data

- Photos of the food you log
- Descriptions of the food and meals
- Estimated caloric content and macronutrients (e.g., fats, proteins, carbohydrates)

2.2. Personal Health Information

- Height, weight, age, and gender (optional)
- Health goals (e.g., weight loss, weight gain, maintenance)
- Activity levels or exercise routines (optional)
- Medical conditions or dietary restrictions (optional)

2.3. Device Information

- Device type, operating system, and application usage data to improve app performance and personalize the user experience.

3. How We Use Your Health Data

We use your health data to:

Estimate the nutritional content of the food you log, including calories, macronutrients, and micronutrients.
Provide personalized health and dietary recommendations based on your goals.
Monitor your progress toward your health and fitness objectives.
Improve the accuracy of our AI in food analysis and dietary recommendations.
Send updates or notifications related to your health and progress.

4. How We Protect Your Health Data

We take the security of your health data seriously. We use technical, physical, and administrative safeguards to protect your health data against unauthorized access, disclosure, alteration, and destruction. These include:

Data encryption during transmission and storage.
Access control mechanisms to ensure that only authorized personnel can access your data.
Regular audits and security assessments to identify and mitigate risks.

However, no method of data transmission or storage is 100% secure, and we cannot guarantee absolute security. By using the App, you acknowledge and accept these risks.

We do not sell, rent, or trade your health data to third parties. We may share your health data only in the following cases:

Service Providers: We may share your data with trusted third-party service providers who help us deliver our services (e.g., cloud storage providers, AI analysis tools). These third parties are bound by confidentiality agreements and are only permitted to use your data for the purpose of providing services to us.
Legal Compliance: We may disclose your health data if required to do so by law, such as in response to a subpoena, court order, or other legal processes.
Business Transfers: In the event of a merger, acquisition, or sale of assets, your health data may be transferred as part of the transaction. We will notify you if such a change occurs.

6. Your Rights and Choices

As a consumer of the App, you have certain rights regarding your health data:

Access: You can access the health data you have provided in the App through your account settings.
Correction: If any of your health data is incorrect or outdated, you can update or correct it in the App.
Deletion: You can delete your health data at any time by removing your food logs or updating your account settings. Upon deletion of your account, all health data associated with your account will be removed from our system.
Opt-Out of Communications: You can opt out of receiving promotional communications or health-related notifications by adjusting your app settings or unsubscribing via the provided links.

7. Data Retention

We will retain your health data only for as long as necessary to fulfill the purposes outlined in this policy or as required by law. If you delete your account or request deletion of your data, we will retain only the necessary information for legal, accounting, or reporting purposes.

8. Children’s Privacy

The App is not intended for use by children under the age of 13, and we do not knowingly collect health data from children. If you are a parent or guardian and believe we have collected personal health data from a child, please contact us immediately so that we can take appropriate action.

9. International Data Transfers

Your health data may be transferred to and stored in locations outside your country of residence, including to countries that may have different data protection laws. By using the App, you consent to the transfer of your data to these locations.

10. Changes to This Privacy Policy

We may update this policy from time to time to reflect changes in our practices, legal requirements, or the features of the App. We will post any updates here and update the “Effective Date” at the top of the policy. We encourage you to review this policy periodically for any changes.
